Like I said - there's two ways around it, but the characters have to be willing to take those other routes.

Contrary to the name, the Inn is quite literally a hole in the ground.

The Inn started out as a wizard's laboratory that was dug several levels into the ground. The first level represented the wizard's personal quarters, while the next three represented assorted labs and storage areas.

Unfortunately, when the wizard died his taxes were in arrears. His kin were able to make off with his more powerful magic items, his notes, and his personal effects; the weaker items and the lab itself were confiscated by the government.
The government attempted to use it for various purposes (such as a barracks and a lab), but soon discovered that it was useless. Although the lower levels were well ventilated, the air in that portion is still quite stale. The soldiers and mages assigned to live in those levels protested, and eventually the government sold the lab off.

The next person to purchase the lab had a radical idea: he would cast "Zone of Sweet Air" into the very structure of the levels themselves, and then use his magic to make it permanent. However, he too ran into financial troubles; at his death, the lab and its contents were seized by a debtor to whom he owed a large sum.
Even after selling most of the contents, the debtor found that he had still not earned back what was owed. His wife sarcastically commented that they could turn the lab into an inn, and make the permanent "Zone of Sweet Air" spell the main selling point; unfortunately for her, he took her seriously.

The Mage's Garden Inn has all the comforts of a modest inn (think Hotel 6 or Day's Inn), in addition to a tavern on the first level. Thanks to the spell, each level smells of a specific type of wild flower. On top of the Inn is a small bazaar, where the vendors rent space from the owners.

Game Play:

The first night that a character spends in the Inn results in no ill effects. However, starting with each subsequent night the character must make a Constitution check (15 + level # + number of nights); failure means that the character is affected by the stale air and will have to spend a number of hours equal to their margin of failure above-ground before they can safely enter the Inn again. If the margin of failure is 12 or more, then the character begins to suffer fatigue.

The current owner of the Inn knows all about this problem, which is why he secretly installed his own personal ventilation system during the most recent renovation. As such, he and anyone who sleeps in his room is unaffected by the stale air. It was his idea to open the bazaar on top, knowing full well that any guest seeking fresh air would have to deal with the vendors. These vendors are more than willing to take advantage of their captive customers, and so they have no problems paying the weekly fee.

Plus there's the ethics involved.

If the party has a paladin, knight, or someone else with a high level of ethics, then if they find out what's going on they'll consider themselves bound to stop what's going on.

Or, if the party has someone with a low level of ethics, that person will want to set up a similar operation for themselves..... unless they decide to somehow obtain this one.
