LOS ANGELES, CA (DPI) - In their first major lawsuit since MP3-sharing pioneer Napster was forced to undergo drastic changes, Grammy-winning heavy metal band Metallica filed a civil suit against 1200 nationwide libraries yesterday, alleging that the "loaning" of the book "Metallica: the Official Story" has cost them millions of dollars in royalties.
"If a library buys a copy of our book, and then loans it out to just anyone who wants it, that's going to cost us, like, big time bank," stated Metallica drummer and spokesman Lars Ulrich. "Each copy read should be bought and paid for, just the same as each individual copy of our CDs. We're not giving this shit away, you know."

In addition to the libraries, the band has sued approximately 32,000 library patrons, all of whom are alleged to have read the book without paying for it, simply based on the fact that they have a "library card," a sinister device that Ulrich likened to "a paper version of Napster."

Reached for comment, one of the defendants named, 17 year old Metallica fan Jim Trench, scoffed at the charges. "Like they don't have enough money already," he complained. "I pay enough for Metallica CDs, videos, DVDs, T-shirts, and all that other crap. What, they're going to sue me for the money I make flipping burgers at White Castle 12 hours a week? Lars Ulrich can kiss my hairy ass."

As of press time, Ulrich had not responded to Trench's settlement offer.

The above was emailed to me by brother...but IF they win, couldn't every author or offspring of the author, sue the libraries?

I like some of their music but they´ve degerated from pure Rock to a bunch of stepdancing morons.

Before you say something, you should look at all the elements invoolved. Metallica came off of the Napster thing as the bad guy to the eyes of fans cause of the whole "greedy" thing. While it is true that Metallica has way too much money, they were some of the first to break the taboo of talking about money and their band. Every other artist (the SMART ones that know what MP3s are and whats happening) all applauded Metallica on having the balls to face scrutiny from the millions of people around the world. Whereas fans see Metallica as greedy assholes, the music industry's members see them as a sort of leader. Since Metallica sued Napster, at least a dozen other major aritsts have come foward saying they are sick of losing money, etc. What Metallica really did was get people in motion, they were the catylyst. If Led Zepplin was still around, and they lost money off of Napster..,they would be right there in the front lines saying how bad it is.

The truth of the matter is that Metallica's suing Napster helped out the little guy. Bands just now getting famous, say like "Puddle of Mudd", lost music to online traders, then the record company doesnt let them make the next record. If it costs so much to make a CD (total, not the CD itself), and a company only makes 1/2 of what they spent, they are not gonna keep that band around. The band gets dropped, no new music gets released, and the fans are stuck with a one hit wonder that COULD have done better...

Dnnt blame Metallica, they were just looking out for themselves and the little guy....blame Elektra, Capitol and Epic...blame the people that make you pay $20 for a CD...

(BTW...I have a nice little report on this I did for English this year. A+, so its decent for reading ^^, ask me if you want to see some of the numbers involved in the whole MP3 problem)

Even thought metallica sued the Napster people there are still sites where you can download free mp3s. I just found a program that does the same thing as napster but you can download images videos and even programs for other users.

The site is http://www.kazaa.com it is a really cool program.

If you downloaded kazaa you have spyware on your system...do a search to find articles about it.

I use MORPHEUS, no spyware and they are pretty good on the DL. Plus you can do pics and videos as well as MP3s.

Morpheus does install a bit of spy onto your system, actually.

Mind you, both Morpheus and Kazaa were purchased in the past three months by the same company, which will be turning each into a pay service.

Time to find a new one.

As for the Napster/Artist thing, *Smart* artists should see Napster for what it is: Free radio play, nationally and internationally. It doesn't cost the average artist a single dime, as they're paid a fixed ammount, rather than have royalties.

Recall a cuople things.

Since a forrestry bill passed in 1998, any artist under a label owns *no* music. Anything they write, be it for an album or for around the house ... heck, a lullaby you wrote for your daughter? The company owns them all. The Artistic Intellectual Property rider was a bad, bad thing, and was the final blow against the artistic community.

Next, the record companies are the real pirates in the comparison. They pay a flat rate to an artist under a standard contract, pay no royalties, and garner massive profits per record, once the break even point is reached. As an exampl, TLC, the most succesful female group in the history of mankind, went bankrupt because of their hit albums. The parent company paid them the usual level, but then charges them for advertising, for the tour, for, basicly, everything they use, but extends a line of credit to pay for things, against the future profits of the next album/tour ...

Sound familiar, Company Store people?

In truth, the record industry as a whole needs to be visited by RICO investigators, but you won't see that for at least three years, after a enw administration is voted in, settles in, and gets enough public pressure on it.

Then again, if *I'm* elected...
