I may be wrong, but I doubt very much that the only way you can paricipate in these events is to own, or use, HeavyMetal Pro. Copies from FASA record sheet books have always been legal, and I'm sure this one is no different. |

We weren't talking about PARTICIPATING, we were talking about ORGANIZING a Martial Olymiad event !
As the Commando which is organizing the event needs a easy way to veryify if the sheets which the players use are correct, he needs a tool, or tousands of photocopied sheets.
Hans, who is organizing our BattleTech events in Vienna, always brings two large boxes with the required material he needs ( these boxes nearly fill the storage area of his car).
With thousands of units & variants of them allowed in the MO, he will need a program like MECH DESIGNER ( programmed by Tracy Kannarr of FMS Techniques, Inc ) which FASA used to produce their sheets on a Macintosh.

P.S.: I hope you have a written permission from FASA to use their record sheets in your program. Otherwise FanPro could drag you to court because of infringement of their copyright if you distribute at least one of their record sheets together with your program.
P.P.S.: Only PHOTOCOPIES have always been allowed

Yes, if WotC gave a damn about me using the artwork, they could complain. The fact is I make no money off the program, nor have the created or gave a license to someone to produce the program. So I doubt they would come after me. But who knows...
As for HMPlus, Rick has a License from WizKids to create the program. Which means everytime he sells a copy of it, he makes money, as does WizKids. So using sheets from the program ARE legal since it is a licensed program from WizKids.

Just ask Mordel what problem he could become with WotC because of his Deckbuilder, especilly as he uses the original artwork from the cards in his program.

I don't mean a copy as in I burn a copy and send it, FanPro would make the order and then I'd ship it out. I don't even have HM+ myself.

If FanPro (or anyone else) orders a copy /I/ ship it out, to whomever they designate. I don't see where you would be shipping anything. And no, that does not sound like what you originally said at all.

This doesnt include using them in a program like HM+ ! Unless the creator of this progam is paying royalities to FanPro ( which are continuing FASA's CBT ), this is infringement of their copyright in the first place.
|

There is no copyright infringement. I have a license, originally with FASA, and now with WizKids to produce the program. I pay royalties. Only the HM programs and the FMS Mac generator are authorized to design and print BattleTech designs.

Sorry, I don't understand why a program is necessary to validated sheets copied from record sheet books. Surely, he isn't entering every design, copied from a RS book, into the program by hand, to verify that the sheet is correct!? Geez, that would take forever!
If you're allowing people to bring copies from the record sheet books themselves, rather than make copies there (as I've done at most events), then you'd either accept them, or check them against the books. A better idea would be to simply have people photocopy them there, from books provided. On colored paper, if you're concerned with them getting mixed with what they bring.
Now, many events are starting to accept custom designs done by HMPro. In order to do so, IMHO, the origanizer should have a (legitimate) copy of HMPro at the event. And people should not bring printed sheets, but rather bring a floppy with the design on it, which can then be loaded into HMPro and printed. Of course, this could/should also be done ahead of time, by emailing or sending the design to the organizer, who could then print them out at his/her leisure, and not be so rushed at game time. But trying to /enter/ custom designs at game time sounds completely impractical to me. And if the organizer doesn't have a copy of HMPro, it's not practical to have a tournament requiring/allowing HMPro.
Please note that I'm not trying to change how you're running the tournament, I'm sure you guys know what you're doing; I'm just mentioning things that have worked in the past and that other people are doing.

Sheesh did this thread take a wrong turn.
1. When I wrote the M.O. I wanted to facilitate players who used the Heavy Metal series of design software by allowing them to use unit sheets printed from this suite. In order to verify that the sheets match the Record Sheets the Commando only need do a quick comparison to ensure that the players sheet passes the smell test.
2. Since the Heavy Metal suite of programs is so handy I had envisioned keeping ten or so copies on hand to furnish Commandos who do not yet own the program. Maybe I'll just ship them out copies of the Record Sheets books. Something I CAN do without everybody freaking out.
3. I know COPY is a bad word, but I was using it in its noun sense, not its verb sense. I guess this misunderstanding stems from that.
4. If I violated any copyrights, I'd get fired very quickly. I have not and will not violate any copyrights, as the the publishing business rightfully takes a very hard line on this issue.
5. Please don't question my integrity again. This is an issue that I take a very hard line on.
I apologize for the misunderstanding. I know where you guys are coming from and can appreciate your points of view.

Thank you Cluth, for clarifying that. I think everyone was concerned that you were giving away copies of the program that were burned onto CD or some such method. Since you are not, we will let it go.
But you are right, this topic has taken quite a turn from its original intention, and thus it shall be closed. If anyone has further issues, take it to Private Message or E-mail.
Thank you... _________________ Mordel Blacknight - Site Administrator
